Terms of Use

• These terms of use (the "Terms of Use"), read together with the privacy policy available at www.retreatsforme.com ("Website") shall constitute a legal and binding agreement ("Agreement") between you and Nueve Technologies(A unit of Nueve Enterprises Pvt. Ltd.) (the "Company" or "We"), having its registered office at A-40, First Floor Rajouri Garden, West Delhi 110027, New Delhi. This Agreement does not alter in any way the terms or conditions of any other agreement you may have with us, or our subsidiaries or affiliates or authorized representative. If you are using the Website on behalf of any entity, you represent and warrant that you are authorized to accept these terms on such entity's behalf, and that you agree to indemnify us for violation of this Agreement. Any capitalized term used in this term of use and not defined herein shall have the meaning as defined in the privacy policy.


• Your acceptance of the Agreement shall be deemed for usage of services offered on the Website. If you do not agree with any provisions of the Agreement, you are required to leave this Website immediately. So, the Company recommends that you must read the Terms of Use and privacy policy fully and carefully. YOUR USE OF SERVICES ON THE WEBSITE MEANS YOU ARE CONSENTING TO THIS AGREEMENT.


• The Company hereby grants you a limited, personal, revocable, non-sub licensable and non-exclusive license to access and use the services offered on the Website for personal purposes. This license granted herein does not authorize use of data mining, robots, spiders, or similar data gathering and extraction tools for any purpose unless otherwise set forth in this Agreement. Any use of the services offered on the Website beyond the scope of authorized access as set forth in this Agreement immediately terminates any permission or license granted herein.


• In addition to the above, you further acknowledge and agree that you will not:
(i). Reproduce or attempt to reproduce the services offered on the Website;
(ii). Modify, adapt, translate or create any derivative works of the services offered on the Website or attempt to do the foregoing;
(iii). Attempt to circumvent or disable the Website in any manner;
(iv). Attempt to decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code for the Website;
(v). Deliberately involve manual or automated software, devices, or other processes to "crawl", "spider" or scrape any content on the Website;
(vi). Remove or alter any trademark, logo, copyright or other proprietary notices, legends, symbols or labels on the Website.



• This Agreement is published in compliance of, and is governed by the provisions of Indian law, but not limited to: the Indian Contract Act, 1872
(i). The Information Technology Act, 2000 (the "IT Act")
(ii). The rules, regulations, guidelines and clarifications framed under the IT Act, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the "SPI Rules")
(iii). The Information Technology (Intermediaries Guidelines) Rules, 2011 (the "IG Rules"); and (iv). The Consumer Protection Act, 1986.

Submission of information

• Account: If you allow a third party, access to the Services through your account, you shall ensure that the said third party is bound by and abides by the terms of this Agreement. All provisions in this Agreement are applicable to the third party..


• The Company authorizes you to access the Website solely for the purpose of using the services offered on the Website mostly through various packages.


• You hereby authorize to the company.
  (i). Render you the services provided by the company.
  (ii). Use your submitted information to contact you.
  (iii). Maintain a record of your queries and feedback.
  (iv). Use all submitted information by you in a manner as it may deem necessary.


• For certain functions of the Website's Services, such as reviewing and tracking your use of the Services or to provide more effective service, you may be required to provide your name, age, mobile or phone number or address and you shall be expected to provide accurate and complete information.


• The Company may, at any time and without having to serve any prior notice to you.
  (i). Upgrade, update, change, modify, or improve the Website or a part thereof in a manner it may deem fit, and
  (ii). Change the contents of this Agreement or the privacy policy. It is your responsibility, in such cases, to review the terms of the Agreement from time to time. Such change shall be made applicable when they are posted. The Company may also alter or remove any content from the Website without notice and without liability. Any material changes shall be highlighted on the homepage.


• The Company reserves the right, at its sole discretion, to suspend your ability to use or access the Website (or a part thereof) or the services offered on the Website at any time while the Company investigates complaints or alleged violations of this Agreement, or for any other reason. Further, it shall also have the ability to prohibit or restrict you from using the Website if, in its opinion, you are misusing the Website in any manner whatsoever.

Services offered on the Website

• Company is in the business of facilitating booking by offering on its web portal excursions/packages/retreats/services/Training courses in the field of Ayurveda, Yoga, Naturopathy and other Wellness domains. It serves both Indian and international clients who are interested in availing services offered by yoga and ayurvedic centres, yoga practitioners, spa resorts, wellness retreats, naturopaths and the likes in alternative medication and rejuvenation segment (collectively referred as "Service Providers"). Company has partnered with various Service Providers and has curated packages for travellers who intend to avail these services. The packages are available on the Website. In addition, the Company also curates packages for its clients on need basis and the Terms of Use apply on the usage of those packages as well. Clients can directly e-mail about their requests [email protected]_______ and the Company will try to revert at the earliest. .

Mode of granting services

• You may opt for any package available on the Website. Each package comes with a set of terms viz. Itinerary, refund and cancellation policy, stay facilities, travel arrangements etc. That are offered by the Service Providers and when you opt for a package, you will be deemed to have agreed to all such terms. If you purchase a package for multiple people travelling together, then all travellers in that booking will be deemed to have read and agreed to the terms of the package. Kindly note, what a package does not provide cannot be claimed from a Service Provider as a matter of right. Neither can a package once purchased, be altered per your convenience. Kindly also note that Company shall not in any event be deemed as party to an agreement between you and the Service Providers. We advise you to carefully read the terms and conditions of each package as well as terms on the website/any forms provided to you, by such Service Providers since they may entail legal obligations and it is your responsibility to adhere to such obligations.

Fee for services

• In order to confirm your booking with us, you will be required to pay the fee stated against the package. Once the fee is received, the Company shall confirm availability of the package and revert with a confirmation in maximum 72 hours. Subject to any changes by the Service Providers at any time, your booking shall be deemed confirmed once you receive confirmation from the Company.


• Should there be any major alteration in the package opted by you, the Company shall, in that case, inform you and provide you with an option to seek immediate refund. Please note, the fee refund shall be received by the Company on behalf of the Service Providers.


• The Website has a fee payment page and fee has to be deposited in Company's account through that page only. Please note, for making payments, you shall not use any credit/debit card that is not legally owned by you and you will solely be responsible for the security and confidentiality of your card details. The information provided by you will not be utilized or shared with any third party unless required in relation to fraud verifications or by law, regulation or court order or in accordance with the terms of the Privacy Policy. You will be solely responsible for the security and confidentiality of your credit/debit card details or pre-paid instrument account. We expressly disclaim all liabilities that may arise as a consequence of any unauthorized use of your cards by you.


• We may have existing arrangements with banks for the purpose of collecting payments under these terms. We may, from time to time, contract with third party payment service providers including banks and credit card payment gateways to open bank accounts and facilitate payment between you and the Service Providers as well as collection of Our fees. Please note, package fee shall be exclusive of airfare from your boarding point, baggage charges, visa fee, travel insurance and any other personal expenses and shall only include inclusions of the package.

Cancellation Policy

• In case you intend to cancel your booking after making payment, you may do so based on the cancellation policy of the different Service Providers and expect refund accordingly. In any event, the packages on the website shall indicate the cancellation policy of each Service Provider. We, however, shall not be responsible for any change in the policies of different Service Providers, though. We reserve the right to cancel any trip altogether at any time if, due to natural disaster, political instability or other disruptions beyond our control ("force majeure events") which have the effect of making the trip unsafe or otherwise unviable. In the event a trip is cancelled due to a force majeure event, the client will receive a refund equal to the monies paid towards a package.

Liability

• Please note, Company is merely facilitating your travel plans by providing a package, on its Website, which is an aggregation of various services offered by the Service Providers. We reiterate, the packages are subject to the terms and conditions, as well as all agreements between you and the Service Provider and we assume no liability whatsoever for any decisions made by you based on any representation (say, through photos) made by a Service Provider through our packages or otherwise, unless otherwise categorically qualified for in these Terms of Use. Company assumes no responsibility for any act or omission committed by you or on your behalf or by a Service Provider once you purchase a package from the Company. Please note you shall be fully liable for your behaviour, health and safety including.


• Ensuring that you are in possession of all travel documents for your trip. Company shall not be responsible if you are refused entry to a country because you lack the correct travel documents


• Any assistance that you choose to take from any trip leader, yoga instructor or local representative in arranging optional activities does not render Company liable for them.


• Having a travel insurance in place


• Adherence with the laws of the land as well as all the rules and code of conduct of any place, hotel, retreat, center or otherwise


• Change in the services that were promised at the time of making payment on the Website


• Health issues that you may incur owing to usage of any services rendered by the Service Provider


• Any mis-representation or fraud committed by the Service Provider


• Getting immunizations which may be necessary or desirable for travel to certain part of the country that you are travelling to.


• Knowing the benefits,procedure,ingredients used, possible side effects if any related to each package you choose to view/book from the portal.


• In no event shall Company and its parent, affiliates, subsidiaries, officers, directors, shareholders, members, employees, successors and assigns be liable for any direct, indirect, consequential or incidental damage, liability, injury, loss, cost or expense you may incur (including any claim relating to personal injury, illness, death, property damage or loss, delay or other inconvenience) arising out of or by reason of the acts or omissions or gross negligence of any third party or Service Providers.

User Covenants

• You must be 18 (eighteen) years of age to use the services offered on the Website.


• You are prohibited from:-
  (i). Violating or attempting to violate the integrity or security of the Website.
  (ii). Using any engine, software, tool, agent or other device or mechanism (such as spiders, robots, avatars or intelligent agents) to navigate or search the Website.
  (iii). Attempting to decipher, decompile, disassemble or reverse engineer any part of the Website.
  (iv). Copying or duplicating in any manner any of the information available on the Website.
  (v). Framing or hotlinking or deep linking any contents from the Website.


• The Company may disclose or transfer information provided by you to its affiliates in other countries, and you hereby consent to such transfer. The SPI Rules only permit the Company to transfer sensitive personal data or information under the SPI Rules including any information, to any other body corporate or a person in India, or located in any other country, that ensures the same level of data protection that is adhered to by the Company as provided for under the SPI Rules, only if such transfer is necessary for the performance of the lawful contract between the Company or any person on its behalf and the user or where you have consented to data transfer.

Third party information

• The Website may provide information regarding third party mobile applications, affiliates or business partners and/or contain links to their mobile applications/websites. Such information and links are provided solely for the purpose of your reference. The Company is not endorsing those websites or mobile applications and you shall access them at your own risk.

Intellectual property rights

• All the intellectual property used on the Website by the Company, shall remain the property of the Company. Content displayed on or through the services offered on the Website is protected by copyright as a collective work and/or compilation, pursuant to copyrights laws.

Indemnity

• You hereby agree to indemnify and hold harmless the Company, its affiliates, officers, directors, employees, consultants, licensors, agents, and representatives from any and all third party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from
  (i) Your access to or use of the Website in any fraudulent manner
  (ii) Violation of the Agreement
  (iii) Infringement, or infringement by any other user of your account with the Company
  (iv) Doing negative publicity of the Company without first reasoning out with the Company and also allowing it to rectify the issue which you faced with Company's services; and
  (v) Infringement of any intellectual property or other right of any person or entity. The Company will notify you promptly of any such claim, loss, liability, or demand, and in addition to your foregoing obligations, you agree to provide us with reasonable assistance, at your expense, in defending any such claim, loss, liability, damage, or cost.

User Submissions

• You understand that when using the Website, you may be exposed to content from a variety of sources, and that the Company is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such content, and you agree and assume all liability for your use. You hereby do waive, any legal or equitable rights or remedies you have or may have against the Company with respect thereto.

Severability

• If any provision of this Agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect.

Term and Termination

• This Agreement will remain in full force and effect while you use the Website and the packages available on it or deal with the Company in any form or capacity.

Dispute Resolution and Governing Law

• This Agreement and any contractual obligation between the Company and you will be governed by the laws of India, subject to the exclusive jurisdiction of courts at New Delhi.
• All disputes will be subject to arbitration at New Delhi,India by a sole arbitrator appointed by the Company, under the Arbitration and Conciliation Act, 1996.

Disclaimer

• The Company hereby disclaims all representation(s) and/or warranty(ies), either express or implied, including without limitation, warranties of fitness for particular purpose, title, non-infringement. In addition, thereto the Company makes no representations, warranties or guarantees that:
• This Website shall be free from any error, loss, destruction, damage, corruption, attack, viruses, interference, hacking, other security intrusion
• The use or results of the use of the Website (including all of its content) is or will be accurate, reliable, current, and/or uninterrupted.
• Knowing the benefits,procedure,ingredients used, possible side effects if any related to each package you choose to view/book from the portal.

• All notices and communications shall be in writing, in English and shall deemed given if delivered personally or by commercial messenger or courier service, or mailed by registered or certified mail (return receipt requested) or sent via email/ facsimile, with due acknowledgment of complete transmission to the following address:
